A. In Simple Terms, What Is Nonintervention Probate? ñ
A proceeding in a Washington Superior Court to
Admit any Will of a Decedent to probate &
Appoint a Personal Representative for the
Decedent & his/her estate
That allows the Court-appointed Personal Representative thereafter to
Collect, manage, & if desired sell the Decedent's property
Pay the Decedent's debts
Determine & settle any taxes due
Distribute the remaining assets to the Decedent's Heirs or Beneficiaries &
Close the estate
Without further Court involvement or supervision following appointment.

Washington law requires that certain legal actions (the Basic Services) be taken to open & close a probate for a Decedent's estate. We offer to perform those Basic Services for 995 + Costs:
Conferring with you to obtain the necessary information
Preparing and presenting to the Court the necessary documents to:
Admit Decedent's Will to probate (if Decedent left a Will),
Get you appointed as Decedent's Personal Representative, &
Obtain Nonintervention Powers for you as Personal Representative (if you are eligible & they can be obtained concurrently with your appointment without additional work).
Sending the required notices of the probate and your appointment after your appointment.
Obtaining an IRS Tax ID Number for the estate.
Closing the estate by preparing & filing a Declaration of Completion of Probate with Receipts & Waivers from the heirs or beneficiaries.
The specific legal tasks performed in the Basic Services are:
Preparing and filing with the Court an appropriate Superior Court Case Information Cover Sheet.
Filing with the Court Decedent's last Will, if any.
Preparing and filing with the Court a Petition for Probate of Decedent's Will (if any), Appointment of Personal Representative, & Grant of Nonintervention Powers.
Preparing and presenting to the Court and having a Judge sign an Order Admitting Decedent's Will (if any) to Probate, Appointing a Personal Representative, & Granting Nonintervention Powers.
Preparing and filing with the Clerk's Office an Oath of Personal Representative.
Obtaining from the Clerk's Office & furnishing to you 4 certified copies of Letters, evidencing your appointment as Personal Representative.
Preparing, mailing Notice of the Personal Representative's Appointment, along with a copy of any Will of Decedent admitted to probate, to Decedent's heirs and beneficiaries, and preparing and filing with the Court proof of that mailing.
Preparing, mailing Notice of the Personal Representative's Appointment, along with Decedent's Social Security Number, to the Washington Department of Social & Health Services and preparing and filing with the Court proof of that mailing.
Obtaining a Tax ID Number ("EIN") from the IRS for the estate, which is a separate, tax-paying entity.
Closing the estate by preparing & filing a Declaration of Completion of Probate with Receipts & Waivers from the heirs or beneficiaries.
2. The Court Costs
Regardless of whether you "do-it-yourself" or obtain legal assistance, the Court costs to open a probate are:
Superior Court filing fee: $230
Superior Court ex parte & probate fee: $30
Court Clerk's fee for certified copies. If you engage us, then upon your appointment as Personal Representative, we obtain:
1 certified copy of the Order: $6
5 certified copies of Letters Testamentary (with a Will) or Letters of Administration (if no Will) --- the document issued by the Court that evidences its appointment of the Personal Representative: $5 each; total of $25

= $31
Total Court costs for filing fee + ex parte & probate fee + certified copies = $291

Individual circumstances vary widely. |
Every probate estate is a little different, and some are more complicated and require more work than others. Our 995 fee should cover opening a Basic, Simple, Problem-free, Uncontested Nonintervention Estate opened through our Usual Process & closing the probate by filing a Declaration of Completion of Probate with Receipts & Waivers from the heirs or beneficiaries. If the facts or circumstances of your case require or if you request additional services, the fee for any such Additional Services will be either a flat fee for "Creditor's Claims Services" or based on actual time spent, billed at our hourly rate, plus any actual costs incurred on your behalf.
D. Bottom Line ñ
The majority of the probates for which we render Basic Services are completed in four to six months & for approximately $1,300 to $1,500 --- total. Some probates require additional work. Most of those are completed for under $2,500. The ones costing more than $2,500 usually have one or more substantial problems, the most common being insolvency (more debts than assets), objections, or disputes.
