Definition of "Basic, Simple, Problem-Free, and Uncontested"
By "basic, simple, problem-free, and uncontested" we mean (for example and not by way of limitation):
The probate may be opened summarily; for example,
Any Will is clear, unambiguous, valid on its face, "self-proving" (ie, may be admitted to probate without further action, such as obtaining witnesses' signatures), and is and remains uncontested.
A Personal Representative is able, willing, and qualified to serve without further action.
No Bond is required by the Court.
The identity of the heirs and beneficiaries is clear, and they are all competent, available, and cooperative.
If Nonintervention Powers are desired, they may be obtained concurrently with the initial appointment of Personal Representative without additional work.
Any Will may be admitted & the Personal
Representative may be appointed without a noticed hearing.
No further personal appearance in Court and no
further hearing or other Court involvement are required
after the initial appointment of the Personal Representative.
